  RESTRICTIONS
  TO PROTECT YOUR INVESTMENT

The below restrictions should be confirmed with the office prior to building or altering your house or land dwellings.

The Bellaview Estate Drysdale has building restrictions to ensure that quality homes and landscaping are implemented. This will create a quality estate. Below is a basic description of the building conditions (please refer to the contract of sale for detailed information in regards to these conditions).

Dwelling Time Restriction:

  • Houses must be completed within 3 years and must be started within 2 years of settlement of the land.
  • No unit development is permitted.
  • Only a single dwelling is allowed to be constructed on any lot.

Building Materials

  • The external walls of the house (excluding windows & doors) must be constructed of items in table A, B or C, provided that the sum of items in table B does not exceed 20% and that Table C is not located on any external walls facing the street frontage and do not exceed 5%.

Table A:

  • Brick
  • Rendered brick
  • Rendered concrete
  • Stone
  • Fibre cement wall board finished with a painted render or textured paint or painted membrane finish.

Table B: (No more than 20% in table)

  • Natural timber
  • Non reflective pre-coated steel
  • Hardieboard

Table C: (Any product which is not located on the street frontage of the house and does not exceed 5%)

  • Any other products
  • No external construction with any second hand materials.

Rubbish and site management

  • Rubbish must be stored in a suitable receptacle for containing and disposal of rubbish. Please ensure that your builder has allowed for a mini skip or similar.
  • In the event of non-compliance the lot owner will be fined $250 per week for in-contained rubbish during the construction of their house.

Building Envelopes

  • Please refer to the plan of subdivision to confirm if your lot is affected by a neighbourhood design envelope.

Garage and Carports

  • A single carport is only permitted on lots smaller than or equal to 400m2
  • Double carports are not permitted on any lots
  • Carports must be connected to the house
  • A one-space carport must have a maximum width of 4 metres
  • Free standing carports are not permitted on any lots.
  • All single carports must have either a panel lift or roller door fitted to the front of the carport so as to screen the internal space of the carport from the streetscape of the lot
  • Carports cannot be forward of the house lot
  • Garages are to be constructed under the main roof of the house, unless the freestanding garage is constructed to match the roof form and materials of the house.

Parking Vehicles

  • Parked commercial vehicles must not be visible from the street. (utilities and small vans are allowed, provided that tools of trade are not visible).
  • Parked caravans must not be visible from the street.
  • No vehicle repairs on the street
  • A lot owner must not carry out any vehicle repairs which are in public view.

Crossovers and driveways

  • Crossovers and driveways must be installed prior to the certificate of occupancy for the house is issued
  • All crossovers and driveways must be constructed from concrete or brick paving
  • No crushed rock driveways or crossovers.

Sheds and external fixtures

  • A shed is defined as an external shed that is not part of your house
  • A shed must not exceed 3.6m in height above natural ground
  • A shed must be constructed of pre-coated steel or brick walls with a pre-coated steel or tiled roof.

Bond

  • A $2,000 bond is to be paid at settlement to ensure these conditions are met.
  • Upon completion of your new home, landscaping and fencing, please request a Bond Release Form from our office. A member of the approvals team will verify compliance. The bond will then be returned to you by the developer’s solicitor.
  • Interest will also be paid in accordance with the contract of sale.
  • If a fine has been issued for non-compliance (such as rubbish not being contained), it will be deducted from the bond and the balance will then be forwarded to you.

Landscaping & external maintenance

  • All ground areas visible from the street frontage must be properly landscaped within 3 months from Certificate of Occupancy.
  • “Proper landscaping” means that all visible areas must be cleared and grassed, planted or otherwise covered with a vegetation constituting a beautiful surface. Each property owner must maintain its lot by cutting grass and keeping the lot and nature strip in a safe and tidy condition.
  • It is the responsibility of the owner of a property to ensure that all vacant lots are kept clear from all rubbish and/or building debris.
  • Vacant lots must not be used for storage of any personal property including building materials and vehicles.

Fencing

  • The developer will supply boundary fencing on the purchaser’s lot upon completion of the house (not front fencing or wing fencing).
  • The owner must supply and install any wing fences prior to certificate of occupancy so that the backyard is not visible from the street.
  • Boundary fencing height will be 1950mm high (excluding the tapered height). The original owner will also arrange for the construction of a 1950mm high timber architectural fence to be constructed along the side boundaries of lots which abut a reserve or a corner lot. A gap of approximately 5mm will be left between the timber battens to allow for casual surveillance of the reserves. The timber fences will be installed and painted to match as best as possible the pre-coated steel fencing.
  • Fencing will not be provided by the developer along/ beside the location of a garage which has been or will be installed on the boundary.

What’s needed to purchase a block?

  • A 5% deposit is required to prepare land sales contracts. We only accept cheque deposits, we do not accept cash or eftpos transactions.
  • We also require the full names of the purchaser/s and their registered address (not a postal address) and the name of your legal representative (e.g. Solicitor or Conveyancer) to whom the land sales contracts will be sent.
